These terms and conditions (the "Terms") apply to the Geniusko service. They govern the relationship between the provider (the "Provider") and you (the "Customer") as a sole proprietor or a legal entity that orders or uses the service in the course of your business. By submitting an order, you confirm that you are ordering the service for that purpose, not for personal use, and that the details in the order are true and current. This confirmation also applies to the introductory discounted period. By submitting an order, you accept these Terms.
Geniusko is for advertising and content for your business. You can create, launch and manage ads on Meta (Facebook and Instagram), and view and manage Google Ads. The AI chat makes those changes after you confirm them. In Studio you can generate images, video and avatars. In Posts you can prepare and publish an organic post on Facebook, Instagram, TikTok and YouTube. In Competition you can see other brands' running ads on Meta. In Tracking you can install a pixel and the Conversions API on your website. In Automations you can turn on rules that keep checking your ads. From a connected store, for example Etsy, you can see a revenue summary next to your ad results. We change an ad account only after you confirm. We do not become the account manager, and we do not take over payment for advertising to Meta or Google. The Meta account is covered in section 2.1. Other connections are covered in sections 2.2 to 2.5.
The Provider connects to the Customer's Meta ad account only on the basis of consent the Customer gives when connecting. From the account the Provider obtains campaign performance data. The Provider changes the account, in particular by creating and launching a campaign, pausing it, turning it back on, or changing its budget, only after the Customer confirms. The ad account remains the Customer's account. The Provider may not use it for another advertiser. Payment of the advertising budget is a matter between the Customer and Meta. By connecting the account the Customer confirms that they are bound by Meta's terms that apply to that account, in particular the Meta Terms of Service, Meta Advertising Standards, Commercial Terms and Self-Serve Ads Terms. If the Customer uses a Meta tool with its own terms through the service, in particular a pixel, the Conversions API or a customer list, the Customer is also bound by those terms, in particular the Business Tools Terms and the Customer List Custom Audiences Terms. Campaigns launched through the service must meet these terms. The Provider processes account data only to measure and optimize the Customer's campaigns on Meta. The Provider may not use it to build profiles, to target people off Meta, or for campaigns on other platforms. The Provider keeps each advertiser's data separate. Access is limited to the Customer and people acting on the Customer's behalf.
By connecting a TikTok account you authorize Geniusko to access your profile, statistics and public videos, and to publish content to your TikTok account when you instruct us to. Content you send to TikTok remains yours. You must follow the TikTok Terms of Service and the TikTok Community Guidelines. Geniusko does not remove watermarks or other TikTok copyright marks.
Before publishing to TikTok you must confirm the TikTok Music Usage Confirmation. We will not send the post without that confirmation.
You may not use Geniusko for spam, misleading content, or to break TikTok's rules. TikTok may limit posts from an unaudited app to private view until it approves our API. You can disconnect TikTok at any time in Integrations.
By connecting YouTube you authorize Geniusko to show your channels and videos and, after you confirm, to upload a video you select. By using these YouTube features you agree to be bound by the YouTube Terms of Service. The video and text you upload remain yours. We do not configure the channel, change comments, or download other people's videos. You can disconnect YouTube at any time in Integrations.
With your consent you can connect your own Google Ads account, a Google Analytics property and a site in Search Console. Geniusko reads only the data described in the Privacy Policy. It changes a Google Ads campaign only after you confirm. We do not become your account manager and we do not take over billing. You can disconnect each integration in the app, and you can also revoke Geniusko's access in your Google account.
Geniusko is a first-party service of Zarabaj Online OÜ. When you connect your own Etsy shop, you authorize Geniusko to read that shop and its receipts so we can show you aggregated daily revenue and order count next to your ad results. We do not act for another app, we do not scrape Etsy, and we do not use the Etsy API to research other sellers or to train AI models on the Etsy catalog. Support for this integration: info@geniusko.com. You can disconnect Etsy at any time in Integrations.
DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY ZARABAJ ONLINE OÜ (THE "APPLICATION DEVELOPER"). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
The term 'Etsy' is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.
Some features of our Services may require an account. You are responsible for keeping your account details confidential and for all activity under your account. You agree to tell us immediately about any unauthorized use of your account.
Content the Customer uploads, creates or sends through the service, including text, images and video, remains the Customer's. The Customer grants the Provider a non-exclusive, royalty-free license for it, only for as long as the Customer uses the service and only to the extent needed to provide the service. The license covers storing the content, displaying it in the app, technically adjusting its format, and sending it to a service the Customer has connected, and only on the Customer's instruction.
The Customer confirms that they have the rights needed for this use, and that content and ads sent through the service do not break the law or the terms of the platform they are sent to, in particular Meta, Google, YouTube and TikTok. The Customer is responsible for third-party claims arising from this content. The Provider may refuse to send content, or remove it from the service, if it breaks the law or these Terms.
Geniusko and its licensors own all intellectual property rights in the Services, including software, designs, algorithms and documentation. Nothing in these Terms transfers any of those rights to you.
Output created in the service, in particular an image, video or avatar, may be used by the Customer in their business for as long as the subscription lasts. Rights in the models and the software remain with the Provider. The Provider does not warrant that the output is accurate or that it does not infringe a third party's rights. The Customer checks it before publishing.
The subscription is paid in advance. In the order you choose an introductory period of 2, 4 or 8 weeks. After it ends, the subscription continues as a monthly plan at the price shown on the order page, until you cancel. The price, currency and VAT treatment are shown on the order page before you pay.
If the Customer has subscribed to the service for a chosen period, a change of plan or the end of the contract during that period does not create a right to a refund of the price paid for the service, including a pro-rata part. This also applies if the Customer does not use the service during that period. The only exception is a claim under the 30-day results guarantee in this section.
The Provider may change the fees. The Provider tells the Customer about a change in advance, before it takes effect. Until that day the price agreed in the order applies. If the Customer does not accept the change, the Customer may cancel the subscription before the day it takes effect.
The Customer may change the plan or cancel the subscription at any time in the app, in Subscription. The Customer does so before renewal. Cancellation takes effect at the end of the period already paid for and does not create a right to a refund of fees already paid. Access continues until the end of that period.
Before the first renewal at the full price we send you a reminder email. We do not send a reminder before later renewals.
The Customer agrees that the Provider will charge the fees to the card given with the order. Before charging, the Provider may check that the card is valid and that it has funds available. The Customer keeps the card details up to date. If a payment fails, section 7 applies.
The 30-day results guarantee is voluntary and is not a statutory right. It applies to the first payment if, within the first 30 days after that payment, the Customer meets the following conditions and the result does not improve. The Customer completes the Agent Marketing System lessons that are available in the app on the day of the first payment, and follows them. In each week of those 30 days the Customer publishes at least one new campaign on Meta or in Google Ads and at least one post on Facebook, Instagram, TikTok or YouTube. The result is reach, the number of potential customers, or the number of customers. The same measure is compared for the 30 days before the first payment and the 30 days after it, on the same account. If any of these conditions is not met, there is no right to a refund of the first payment.
Ask for a refund by email to support@geniusko.com no later than the 30th day after the first payment. After we approve it, we refund the payment within 14 days, by the same method you used to pay, and the subscription ends.
The guarantee is given only once, for the first payment of a new Customer. One business has at most one claim, even if more than one account was created. A renewal payment is not covered by the guarantee. This also applies when the introductory period is shorter than 30 days, if the first monthly renewal happens before that period ends.
The Provider may withdraw from the contract or suspend access if the Customer materially breaches the contract. A material breach includes, in particular, a failed payment, a breach of these Terms, a threat to the security of the service, or a duty arising from the law. If the details in the order do not match, the Provider may ask for them to be completed or check them in a public register. If it is not shown that the service is used for a business, the Provider will not accept the order or will suspend access. For a breach that can be remedied, the Provider notifies the Customer and sets a period in which to remedy it. If security is at risk, or a legal duty requires it, the Provider may suspend access without prior notice. The Customer may cancel the subscription under section 6. Ending the contract does not affect the duty to pay the price for a service that has already been made available, or a claim that has already arisen under the 30-day results guarantee.
The app matches what these terms and the order page describe. We do not promise a particular advertising result, uninterrupted operation, or that artificial-intelligence output will be correct. You check content before you publish it. The only promise of a refund is the 30-day guarantee in section 6, and only on the conditions set out in that section.
If you buy as a business, we provide the Services on an as-available basis, and warranties implied by law are excluded to the extent the law allows.
To the extent the law allows, the Provider is not liable for lost profit, lost revenue, an outage of a third-party service, or other indirect loss. The Provider is also not liable for the result of advertising on Meta or Google, or for an interruption caused by those platforms. The Provider's total liability to the Customer is limited to the fees the Customer paid in the 12 months before the claim arose. If the statement that the service is ordered for a business turns out to be untrue, the Customer is liable for the loss the Provider suffers as a result.
When using conversion-measurement tools (the Meta Pixel and the Conversions API), the Customer may send personal data of their visitors and customers to Meta through Geniusko. For that data the Customer is the controller and Geniusko (Zarabaj Online OÜ) is the processor, which processes it only on the Customer's instructions. The Customer is responsible for having a lawful basis for the processing, for obtaining from visitors every consent the law requires, and for giving them the required information, for example a cookie notice and a privacy policy on the Customer's website. The Provider passes this data to Meta as a further processor. The other processors are listed in the Privacy Policy. The Provider deletes the data on request, in line with the data-deletion page.
These Terms and the contract between the Provider and the Customer are governed by the law of the Republic of Estonia. Disputes that the parties do not settle by agreement are decided by the court of the Republic of Estonia that has subject-matter and territorial jurisdiction according to the Provider's registered office.
We may update these Terms from time to time, for example when the service, prices or the law change. We will tell you about a material change in advance, within a reasonable time, by email or in the app. If you do not accept the change, you may cancel the subscription before it takes effect. If you do not cancel, the change applies to you from the day it takes effect. A change does not affect payments already made.
